Divorce/Separation – A Woman’s Rights

If you are in the process of divorcing your husband or are separated from him and you have taken his surname as your married name, you can change revert back to your maiden name using a Deed Poll document. If you choose to use a Deed Poll to change your married name, you do not need the divorce to be completed and you can do this any time. Alternatively you could wait for the divorce to complete and use the decree absolute to get your married name changed back to your maiden name.

Changing your name upon separation does not affect your application or the process of the divorce itself. You simply use your maiden name for the divorce proceedings instead of your married name.

Additionally the Deed Poll document gives you the additional benefit of being able to change any of your other names and not just your maiden name. You can change any part or indeed all of your current name using the Deed Poll documents we provide. You can also use our Deed Poll documents to change your title from Mrs to Ms or Miss.

Divorce – A Woman’s Rights

When a woman gets the decree absolute she can revert back to her married name. In order to do this she needs the decree absolute and the marriage certificate as evidence to change her married name back to her maiden name. Getting the decree absolute can be a tedious process and although the decree absolute with the marriage certificate will be accepted by all governmental bodies as sufficient evidence to change her married name back to her maiden name. Some banks and financial institutions may not accept the decree absolute as being sufficient.

If any organisation refuses to accept the decree absolute and marriage certificate as being sufficient evidence to revert your married name to your maiden name then you can use the Deed Poll document to do this. If you decide to change any other part of your name then you will need the Deed Poll document in order to do this and the decree absolute and marriage certificate would not be sufficient evidence to do this. It is also possible that you no longer have the decree absolute or your marriage certificate on hand, in which case using the Deed Poll document would be the most convenient route.
